Terms and Conditions

These Terms of Service are a legally binding agreement between you and Booka Inc. ("BOOKA", "we", "us", or "our"). They govern your use of the Booka website, mobile application, and related services.

Your use of the Booka platform constitutes acceptance of these terms and our Privacy Policy. If you do not agree with these terms, you should not access or use the Booka platform.

You represent that you are at least 18 years old, can form a binding contract, and will use the Booka platform only in accordance with these terms and applicable law.

Booka provides beauty, health, and wellness booking services through the Booka platform. The platform facilitates the booking and sale of services between consumers and providers.

Booka is a booking platform and is not a party to any service agreement or other transaction between consumers and providers. Providers are responsible for the services they offer, and consumers are responsible for evaluating whether a service is appropriate for them.

Booka may provide tools that relate to a booking, including tools to book services, facilitate payments, manage scheduling, and support customer communications.

To use certain features of the Booka platform, you may need to create an account and provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

The Booka platform is only available for use and download in the United States.

Bookings are subject to provider availability, provider policies, and platform requirements. Submitting a booking request does not guarantee that a service will be provided unless the booking is accepted or otherwise confirmed.

You agree to provide accurate booking information, arrive on time, follow provider instructions, and comply with cancellation, rescheduling, payment, and service policies shown during the booking flow.

Separate agreements, waivers, intake forms, or provider-specific terms may apply to certain services. Those agreements are between the consumer and provider unless otherwise stated.

Booka may facilitate payments, deposits, fees, tips, promotional credits, gift cards, and other transaction-related features through third-party payment processors.

You agree to pay all amounts shown at checkout or otherwise associated with your booking, including applicable taxes, cancellation fees, no-show fees, and other charges disclosed before confirmation.

Payment processing is subject to the terms and policies of the applicable payment provider.

Providers are solely responsible for the accuracy, safety, legality, quality, suitability, and delivery of the services they list or provide through the Booka platform.

Providers are responsible for maintaining all licenses, permits, insurance, supplies, and compliance obligations required for their services.

Consumers should review service descriptions, suitability guidance, provider policies, and any forms or instructions before receiving a service.

Users may be able to submit, post, upload, or otherwise provide content such as reviews, photos, messages, listings, service descriptions, and other materials.

You are responsible for the content you provide and must not submit content that is unlawful, misleading, infringing, harmful, abusive, or otherwise inconsistent with these terms.

You grant Booka the rights needed to host, use, display, reproduce, modify, and distribute user content for the purpose of operating, improving, and promoting the Booka platform.

You agree not to misuse the Booka platform, interfere with its operation, attempt unauthorized access, scrape or copy platform data without permission, impersonate others, or use the platform for unlawful purposes.

Booka may suspend, restrict, or terminate access to the platform if we believe you have violated these terms, created risk or legal exposure, or engaged in conduct that could harm Booka, providers, consumers, or others.

Our Privacy Policy describes how we collect, use, disclose, and protect personal information. By using the Booka platform, you consent to the practices described in the Privacy Policy.

You agree that Booka may contact you by email, phone, text message, push notification, or other communication channels for account, booking, transactional, support, and service-related purposes.

The Booka platform is provided on an as-is and as-available basis. To the maximum extent permitted by law, Booka disclaims warranties not expressly stated in these terms.

Booka does not control and is not responsible for provider services, user content, provider availability, service outcomes, or third-party websites and services linked from or integrated with the Booka platform.

To the maximum extent permitted by law, Booka will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Booka platform.

Nothing in these terms limits rights that cannot be limited under applicable law.

These terms include dispute resolution provisions, including arbitration and class action waiver terms, to the extent enforceable under applicable law.

You may have the right to opt out of binding arbitration within the period and by the method described in the full terms or applicable notices provided by Booka.

Booka may update these terms from time to time. Updated terms become effective when posted unless a different effective date is stated.

Your continued use of the Booka platform after updated terms are posted means you accept the updated terms.

These terms, together with our Privacy Policy and any additional terms that apply to specific features, constitute the agreement between you and Booka regarding the Booka platform.

If any provision of these terms is found unenforceable, the remaining provisions will remain in effect. Booka may assign these terms in connection with a merger, acquisition, reorganization, or sale of assets.
